Privacy Statement  for Applicants

This privacy statement (“Statement”) applies to the processing of personal data of applicants that apply for vacancies with Just Eat Takeaway.com or one of JET Affiliates (hereinafter referred to as “JET”). 

At JET we are committed to protecting the privacy of everyone in our community. This means that we’ll protect the personal information of our applicants. JET therefore adheres to the requirements of the applicable privacy and data protection legislation when processing personal data. The data controller for processing these personal data is Just Eat Takeaway.com Group B.V. and/or the JET Affiliate (including the subsidiary companies of Just Eat Takeaway.com N.V.). 

What and why we process personal data

Personal Data, in this Statement also referred to as “your Data”, means any information or set of information from which we are able, directly or indirectly, to personally identify you, in particular by reference to an identifier, e.g. name and surname, email address, phone number, your resume, a reference letter, etc. It does not include data where the identity has been removed (anonymous data).

  1. Application process

JET processes personal data about you because you have applied for a vacancy with JET. We process this data for the selection process and hopefully to welcome you in the future as an employee of JET. The legal ground for this processing is that we consider your application as a request to take steps prior to entering into a contract (employment agreement), for us to comply with legal obligations or to pursue our legitimate interests, and/or any other legal basis otherwise permitted in accordance with the applicable data protection regulation. Where legally required or permitted, we may process your personal data based on your consent. If we rely on your consent as a legal basis for processing your Data, you may withdraw your consent at any time.

JET values diversity and inclusion. Equal employment opportunities mean we offer equal treatment to all applicants. In order to ensure equal employment opportunities as permitted or required by local law we may gather personal data for this purpose.

We only process personal data that you provide to us via the website, the application form, sent resumés or by other means during the application process. We process the following personal data categories:

Please note that, it is mandatory to prove your identity by submitting valid documents to be able to work with us. After submitting your documents, you will be asked to take a selfie so that we can match your documents with your applicant profile. We will use an automated process to compare facial scan data extracted from the photo in your driver’s licence/other identity document to the facial scan data extracted from the selfie photo which you have submitted. The comparison is then used by automated means to determine whether or not you are the person displayed in the photo of the driver’s licence/other identity document. The lawful basis for verifying and authenticating your identity by facial scanning and comparison is your consent , which you may withdraw at any time. However, you can choose not to provide a selfie. In this case, you will be contacted by our recruitment team in your region where you will be invited for a manual verification. Not uploading a selfie will in no way jeopardise your chances to ride with us.

Upon your request we will offer you support and assistance via talent acquisition teams and our communication channels. Per your preferences, we will contact you by phone call, phone or email messaging, to provide you with information relating to your application and to fulfil your requests. If you expressed interest in personalized job opportunities recommendations, we may inform you of available opportunities for employment within JET. 

  1. Application assessments

JET may ask you to perform an assessment during the application process. These assessments are conducted to get a good understanding of your competencies. Your answers in assessments will be evaluated, possibly in an automated manner (for more information see the automated decision making section), and based on the evaluation the decision about your application will be made. The legal ground for this processing is that we consider the assessments as necessary to take steps prior to entering into a contract (employment agreement). JET may process the following personal data categories for assessments:

  1. Applicant Satisfaction Research

To make sure that our services are aligned with your preferences and to improve our services and platforms, JET may approach you to conduct research; such as but not limited to, surveys. We only send you these types of communications with your prior consent, unless this is not necessary according to the applicable law. Participation in this research is completely voluntary. If you do not wish to receive these surveys you can unsubscribe from them in the accompanying messages. JET may process the following personal data categories for research purposes:

During the application process JET may require you to provide information for- or conduct a background and/or reference check.   1. Information JET may collect through other sources 

To the extent permitted by applicable law, in addition to our recruitment channels or career websites, we may also obtain information about you from other sources, such as through your interactions with JET employees or from third parties, such as recruiters, recruitment agencies, LinkedIn or other websites on the Internet (subject to such third parties privacy notices). The legal ground for this processing is that we consider your application as a request to take steps prior to entering into a contract (employment agreement), for us to comply with legal obligations or to pursue our legitimate interests, and/or any other legal basis otherwise permitted in accordance with the applicable data protection laws. JET may also use your personal data to be able to analyse your use of JET applications so we can improve the applications you use during your application process. The legal basis for this processing operation is that it is needed in pursuing a legitimate interest of JET (analysis & reporting) as defined in applicable (local) laws. Where legally required or permitted, we process your personal data based on your consent. If we rely on your consent as a legal basis for processing your Data, you may withdraw your consent at any time.   1. JET Premise visits

If you visit our premises, for security reasons and in line with local requirements we might  record your Data through video or other electronic, digital, or wireless surveillance systems or device (e.g. CCTV). The legal basis for this processing operation is that it is needed in pursuing a legitimate interest of JET as defined in the applicable data protection regulation. 

Additional purposes

We will only use your personal data for the purposes described above, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we want to use the data for a different purpose, we will take appropriate measures to inform you, consistent with the significance of the changes we make. Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where required by applicable law.

Automated decision-making and profiling

For the purposes described above we may use automated decision-making and profiling. Automated decision-making takes place when an electronic system uses personal information to make a decision without human intervention. In limited circumstances, with your explicit written consent where required by applicable data protection law and where appropriate measures are in place to safeguard your rights, we will use automated decision-making. 

You will not be subject to decisions that will have a significant impact on you based solely on automated decision-making, unless we have a lawful basis for doing so and we have notified you. When such automated decision-making and/or profiling leads to a negative decision about you, and you do not agree with it, you can contact us via our privacy form. We will then proceed to reassess the situation.

Age

Our website and vacancies are not intended for persons defined as underage by applicable local laws, nor do we intend to collect personal data of website visitors who are under the defined legal age. However, we are unable to verify visitors’ or applicants' ages. We therefore advise parents and/or legal guardians to monitor their children's online activities, to prevent their personal data being collected without parental consent. If you feel that we have collected personal data of a minor without consent, please contact us via our privacy form. We will then proceed to erase this data.

Sharing with others

JET may work with other companies within the JET group and other third parties in order to carry out the processing described above. 

These group companies and third parties will process your personal data on behalf of us (as data processors) or as autonomous data controllers, and have access to your personal data for the purposes described in this privacy statement. We require group companies and third parties to protect it in accordance with the standards set out in this privacy statement and we take appropriate measures pursuant to the applicable data protection laws to guarantee the same level of protection and confidentiality of your personal data.  

We will also share your Data with other third party data controllers where appropriate or required by applicable law or regulation (including a court order) or where we believe disclosure is necessary to exercise, establish or defend legal rights or to protect the vital interests of any person. Such third party controllers may include law enforcement agencies. 

We may also disclose your Data to any company or prospective buyer of all or substantially all of our assets in connection with any sale or transfer of those assets.

Our website may include links to third-party websites. When accessing such third-party websites, bear in mind that each of these websites has its own privacy statement. Although JET takes great care in selecting websites to link to, we cannot take responsibility for the way in which they handle your personal data.

Where your data gets sent 

We may transfer your personal data outside of the European Economic Area (EEA). This may include transferring it to or accessing it from other jurisdictions, including jurisdictions that may not provide a level of protection equivalent to the your local- and/or data protection laws. Where we transfer personal data outside the EEA we will take into account any applicable statutory obligations relevant to personal data transfers and, where there is no European Commission (EC) adequacy decision in place, we will rely on appropriate safeguards, including EC approved standard contractual clauses. We have implemented similar appropriate safeguards with our third party service providers and further data can be provided upon request.

How long we keep your data

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data, whether we can achieve those purposes through other means, and the applicable legal, contractual or similar requirements to retain your personal data.

In some circumstances we may anonymise your personal data so that it can no longer be associated with you, in which case we may use such information without further notice to you.

We inform you that, with regard to the personal data, you can exercise the rights provided for by applicable data protection laws, which may include: 

  • The right to be informed: Obtain information about our collection and use of your personal data. 
  • The right to access: Get access to the personal data we hold about you, gain information on how your personal data is being processed by us and under certain conditions obtain a copy of your personal data undergoing processing.

Privacy Statement for Scoober App

This privacy statement (“Statement”) applies to the processing of personal data of “Couriers” employed by the Just Eat Takeaway.com (“JET”) or Couriers engaged through a third party. In order to have our Scoober delivery service function properly, we collect and use certain of your personal data. JET takes your privacy seriously and we want to inform you about the data we collect from you, the manner in which we use your data, and for which purpose we use it within the Scoober App. The terms “we”, “us” or “our” refer to Takeaway.com Group B.V., which is the data controller.

Where you are an employee of JET, JET may collect and process additional information about you in the management of the employment relationship. If you are engaged through a third party, JET will process some additional information on the basis of our legitimate interests to manage our relationship with you. More details of this processing are set out in our Employee Privacy Statement. In case of conflicts between this Statement and the Employee Privacy Statement the clauses of this Statement will prevail. 

It is important that you read this Statement, together with any other privacy statement we may provide on specific occasions when we are collecting or processing personal data about you, so that you are aware of how, why we are using such data, your rights regarding your personal data and how to exercise them.

The English version of this Statement shall prevail in case of conflicts between the different language versions.

What data is processed in the Scoober App

Personal data, or personal information, means any information about you from which you can be identified. It does not include data where the identity has been removed (anonymous data). 

The moment you start your shift with us, you are required to activate the Scoober App (hereinafter: “App”). This following data is collected through the Scoober app and stored by us:

  • First and last name
  • E-Mail address and Password
  • Timestamps relating to:
    • Your accepted shifts;
    • Your start and end times; and
    • Your job interactions, including geo-fenced timestamps for food collection and delivery 
  • Your live GPS location
  • Your availability and planned absence 
  • Phone number
  • Device data collected for analytics purposes, including your model, manufacturer, MAC Address and software version.

Why we process personal data

using the App, JET may process your personal data for the following purposes:

  1. Shift planning and Human resources

To enable you to work as a Courier, the Scoober app provides you with the option to give up your availability and plan your working shifts. The Scoober app also enables you to contact the JET Human Resources department for any comments or questions (e.g. to inform us about sickness). The legal ground for this purpose is the performance of our contract with you.  

  1. Order delivery planning and optimisation

Your live GPS location is used for order delivery and optimisation. This enables us to run our delivery service as effectively as possible and subsequently ensure that orders are allocated to you and you only have to ride the shortest distance possible each time. To enable the order delivery the Scoober App provides a chat function to communicate directly with order dispatchers to discuss possible issues. The legal ground for this purpose is the performance of our contract with you. 

Your GPS location is processed during your active shift or 30 minutes pre-shift if you actively activate your Scoober app early. As soon as you actively end your shift or start a pause (stop/pause button in the app) your GPS location will no longer be processed. Your GPS location is relayed to us at 15 second intervals. Motion data are processed via the App by default but will not be registered or used by us.  

  1. Food Tracker

Your live GPS location, together with your first name, is relayed to the customer during the delivery of the order. We call this the Food Tracker. This Food Tracker enables customers to easily check the status of their order, and allows them to identify your live location for the duration of your delivery (with consumers able to track your live location once you have collected their order). The legal ground for this purpose is the legitimate interest of JET. 

  1. Support questions

The App allows you to ask support questions related to the App or your job. JET will use this data to provide you with the necessary support. The legal ground for this purpose is the performance of our contract with you. 

  1. App Analytics

Personal data that is processed within the app is also used by us for analytical purposes and to improve the app and delivery process. Analytics data will be anonymized as much as possible and will never be used for purposes other than the improvement of the App and processes. The legal basis for this processing of personal data, as defined in the GDPR, is the legitimate interest of JET unless your consent is necessary according to the applicable law.

  1. Performance improvement and evaluation 

If you are an employee of JET or working as a Driver but employed by a third party employer, JET will also use your personal data to improve the Driver performance on both a global and individual level. The following data is gained via the Scoober App, Salesforce, Shiftplanning tool, for this purpose:

  • Driver's data on Salesforce, like first name, last name, phone number, email address, contract type, recorded notes from previous evaluations, etc
  • Orders delivered 
  • Timestamps of order milestones (acceptance, pickup, dropoff)
  • Planned availability and worked shift data (planned and worked hours, login and logout times, shift cancellations and unexcused absences) 
  • 'Performance Entries' raised by Live Ops Agents during the shift to flag incidents to the Driver's manager 

The data gained through the Scoober App together with your employment data will be used for your individual performance evaluation. Your evaluation will always involve the judgement of the HUB- and/or City Coordinators and will never be based solely on the gained data or on automated decisions made based on this data.

Our use of tracking technologies

All of our uses of your data make use of tracking technologies on your device. Mobile users can often refuse tracking or reset their device identifiers (which will reset any prior tracking history) through the settings menus on their device. Please note that if you turn off the tracking settings on your phone, the App will not work properly and your phone will prompt you to switch the location settings back on. We really need your GPS location to provide you with App’s core services and turning this off means that the App cannot notify you of delivery opportunities, which will impact your ability to make money and may be contrary to the terms of your employment. We will only use your personal data for the purposes described above, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we want to use the data for a different purpose, we will take appropriate measures to inform you, consistent with the significance of the changes we make. Sharing with customers and restaurants

When using the Scoober App during the delivery of an order, both the restaurant and the customer will be able to see your first name and your location while you are on delivery. Your personal data will only be shared with the customer and restaurant during the delivery of the order and will no longer be available once the order has been delivered. 

Sharing with others

will only disclose your personal data to third parties if necessary for the purposes described above. In addition, we may also disclose your data to law enforcement agencies, competent government authorities and other third parties where we believe we are required to do so by applicable law or regulation (including a court order), or where we believe disclosure is necessary to exercise, establish or defend legal rights or to protect the vital interests of any person. We may also disclose your data to any company or prospective buyer of all or substantially all of our assets in connection with any potential sale, restructuring or transfer of those assets.
